The Supreme Court of India has passed a verdict and has said that the period of suspension can not be for an indefinite period in the case of an employee or officer. Suspended officials of Gujarat are happy with this verdict.
Commenting on this, the Supreme Court canceled an IG suspension of six years. It is possible to benefit from this verdict when many officials in Gujarat are currently suffering from suspension.
Justice A S Bobde's back said in his verdict that the government feels that if the accused is capable of tampering with the evidence then he can be kept in another place. Tamil Nadu's IG Pramodikumar was accused of taking money from a company's directors. These directors were involved in the problem of investing Rs 1,200 crore of investors. IG was suspended after arrest. IG had challenged the proceedings against Kate.
Kate refused to intervene in a departmental move but canceled her suspension. The officer appealed in the Madras High Court. The High Court also canceled the accounting procedures of IG against suspension.
The court said that the charge sheet given to the officer did not get permission from the Disciplinary Authority. Against whom the government appealed to the Supreme Court. The Supreme Court bench said that Rule 8 says that the charge sheet will be made by the Anushasan Samiti. This rule can not be ignored. The Supreme Court has given relief to the officials or employees who have not been receiving punishment like suspension for a long time.
